				<description> &lt;p&gt;The Occupational Safety and Health Administration has issued a final rule that extends the deadline for crane operator certification requirements in the crane standard by three years to November 10, 2017.&amp;nbsp; During the three-year period, OSHA says it will re-address operator qualification requirements including the role of operator certification.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
OSHA announced its much anticipated decision after holding a series of stakeholder meetings in April last year followed, in February, by a Notice of Proposed Rulemaking to extend both the deadline for operator certification and the employer&amp;#39;s duty to ensure competent crane operation. OSHA finalized its decision to extend after analyzing industry&amp;#39;s responses to the proposal, including those voiced at a public hearing in May,&amp;nbsp; Comments from the hearing are available at &lt;a href=&quot;http://www.regulations.gov/#!docketDetail;D=OSHA-2007-0066&quot;&gt;www.regulations.gov/#!docketDetail;D=OSHA-2007-0066&lt;/a&gt;.&lt;br /&gt;

The final cranes and derricks rule, published in 2010, required crane operators on construction sites to meet one of four qualification/certification options by November 10, 2014. After the final rule was published, NCCCO became aware of OSHA&amp;#39;s interpretation of certain aspects of this requirement and brought the matter to the attention of industry.&amp;nbsp; Of particular concern was OSHA&amp;#39;s apparent misunderstanding of the intent of the Cranes and Derrick Advisory Committee (C-DAC), that drafted the rule, to require certification &amp;quot;by type and capacity&amp;quot;.&amp;nbsp; Also at issue was whether certification was equal to qualification.&amp;nbsp; NCCCO understands that OSHA&amp;#39;s plan during the three years consists in part of developing requirements that, in addition to certification, an employer would have to meet in order for his/her operators to be considered qualified.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
Employers are not &amp;quot;off the hook&amp;quot; during this extension period, however.&amp;nbsp; The rule also extends by three years the employer&amp;#39;s responsibility to ensure that crane operators are competent to operate a crane safely.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
NCCCO&amp;#39;s position remains that any delay in the implementation of a process which has been proven to improve safety on construction sites by reducing the incidence of injuries and fatalities is regrettable.&amp;nbsp; However, it is necessary in order for OSHA to address industry&amp;#39;s concerns and to bring all aspects of the crane operator requirements into line with C-DAC&amp;#39;s original intent.&lt;/p&gt;

&lt;p&gt;The long hours and demanding nature of driving a truck can make it a hazardous occupation; fatigue is one of the main occupational hazards commercial drivers face. A new resource available in time for Truck Driver Appreciation Week from the National Institute for Occupational Safety and Health (NIOSH) provides truck drivers with tips for improving sleep quality to improve their health and help reduce the risk for drowsy driving and vehicle crashes.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
According to the Bureau of Labor Statistics, in 2009 truck drivers experienced 16.8% of all transportation-related fatalities and 2.04% of the nonfatal injuries requiring days away from work, even though they only made up 1.0% of the U.S. workforce.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
&amp;ldquo;Sleep plays a critical role in our personal well-being; being on the road for long periods without getting adequate sleep may place truck drivers at higher risk for vehicle crashes, as well as create other health concerns,&amp;rdquo; said NIOSH Director John Howard, M.D. &amp;ldquo;This new resource provides easy to implement solutions that will help truck drivers stay safe and well while on the job and continue their good work.&amp;rdquo;&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
In a 2010 study, NIOSH researchers&amp;nbsp; found that U.S. long-haul truck drivers were twice as likely to be obese compared to the adult working population, as well as more likely to suffer from other risk factors for chronic disease.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
The new publication, Quick Sleep Tips for Truck Drivers, outlines the importance of sleep for truck drivers and&amp;nbsp; what they can do to ensure they get a good night&amp;rsquo;s sleep while on the road and at home. The brochure provides tips and recommendations on the following:&lt;/p&gt;

This new industrywide draft standard provides end-users with more OEM equipment data and more convenient access, which allows them to better manage and analyze information across their fleets, and helps them save time and money on the job site or within their operations.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
The standard is a collaborative effort of the Association of Equipment Manufacturers (AEM) and the Association of Equipment Management Professionals (AEMP), working on behalf of their members and the industry. &amp;nbsp;&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
To achieve a globally recognized standard for conformity worldwide, the AEM/AEMP Draft Telematics API Standard will be submitted for acceptance by the International Organization for Standardization (ISO).&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
&lt;strong&gt;Expanded equipment data, one program to manage mixed fleets&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;The AEM/AEMP Draft Telematics API Standard expands the original AEMP Telematics Standard to include 19 data fields (with fault code capability).&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
The Draft API standard also changes how the data is accessed: via an Application Programming Interface (API) with standardized server-to-server communication protocols, so end users with mixed equipment fleets can use their own business systems and software without the need to work across multiple telematics provider applications.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
The Draft API standard&amp;rsquo;s secure internet protocol allows for manufacturer protection of proprietary information; disclosure to third-party companies for the purpose of aggregation is not permitted.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Must sign up online to receive Draft API standard&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;While access to the AEM/AEMP Draft Telematics API Standard is free, industry professionals must sign up directly via the AEM or AEMP websites to be sent the draft standard and to receive any future updates or additional documentation. Anyone who has previously signed up should receive the draft standard during the first week in September.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;

&lt;p&gt;The associations caution that while they are making the draft standard available now to help companies become familiar with its contents for business planning purposes, the document is still a work in progress. Final language is dependent upon completion of the ISO acceptance process.&lt;br /&gt;

The company was ordered to pay a total of $953,916 in damages: $243,916 in back wages to the drivers, $110,000 in compensatory damages and $600,000 in punitive damages.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
&amp;ldquo;It is illegal for an employer to retaliate against employees who report work-related safety concerns or violations of federal transportation regulations, which require drivers to have a minimum 10-hour rest period between shifts,&amp;rdquo; said Assistant Secretary of Labor for OSHA Dr. David Michaels. &amp;ldquo;OSHA is committed to protecting workers from retaliation for exercising basic worker rights.&amp;rdquo;&lt;br /&gt;

The foreman was terminated from employment on June 30, 2012. The foreman repeatedly raised concerns to the company&amp;rsquo;s co-owner about exceeding hours of service when job assignments repeatedly failed to allow for the 10-hour rest period mandated by the Department of Transportation. At least twice, the foreman and the crew were expected to work more than 27 hours straight. The employee rightfully refused to operate a vehicle in an unsafe manner, which could potentially cause serious injury to the worker, co-workers or the public. OSHA has ordered the foreman to be reinstated and to receive back wages of $147,457, less any applicable employment taxes; $50,000 in compensatory damages and $200,000 in punitive damages.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
The second truck driver was terminated from employment on April 26, 2013. The employee also raised concerns about the number of work hours required by the company and refused to sign an affidavit denying that the worker was required to work in excess of the number hours legally permitted. Asphalt Specialists sought the affidavit to use in their response to OSHA&amp;rsquo;s investigation of the fired foreman&amp;rsquo;s claims. OSHA has ordered this driver to be reinstated and to receive back wages of $44,379, less any applicable employment taxes; $30,000 in compensatory damages and $200,000 in punitive damages.&lt;br /&gt;

The third driver was terminated from employment on July 8, 2013, after raising concerns about vehicle maintenance and about the number of hours they were expected to drive. OSHA has ordered the driver to be reinstated and to receive back wages of $52,080, less any applicable employment taxes; $30,000 in compensatory damages and $200,000 in punitive damages.&lt;br /&gt;

The Surface Transportation Assistance Act covers private-sector drivers and other employees of commercial motor carriers. Heat-related illnesses are the body&amp;rsquo;s response to a hot environment and outdoor workers are at especially at risk of heat-related illness during the hot summer months. Working in hot environments and/or prolonged exertion can raise the body&amp;rsquo;s temperature, resulting in heat stress in workers. Heat stress may lead to heat exhaustion, heat cramps, heat rashes, and heat stroke. Heat stroke is the most severe form of heat related illness and can be fatal if not quickly treated. The symptoms of heat stroke include a change in mental status that can range from confusion or bizarre behavior to seizures or loss of consciousness.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
Employers should establish a heat illness prevention program that should include assigning outdoor tasks at night or during cooler weather if possible, providing rest periods in shaded or cool areas, ensuring employees have access to water or other hydrating beverages, implementing a mandatory buddy system, and training workers to recognize symptoms of heat-related illness. This is essential as someone with heat stroke often will not be aware they are not functioning normally.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
Another key to preventing heat-related illness is to acclimatize workers and allow frequent breaks for new workers or those who have been away for a week or more to build a tolerance for working in the heat. Acclimatization is the adjustment the body makes after being gradually exposed to hot environments. If you have pre-existing medical conditions, a doctor should clear you before starting work in a hot environment.&lt;br /&gt;

Some helpful tips for outdoor workers to help prevent heat related illness and fatalities:&lt;/span&gt;&lt;/p&gt;

Six months earlier, a 25-year-old construction worker in Chicago was struck and killed by pieces of falling concrete while conducting renovations on a shopping mall. These tragedies follow the June 5, 2013, collapse of a four-story building undergoing demolition in Philadelphia that killed six people and injured 14. These deaths could have been prevented. To help prevent these tragedies and save lives, OSHA has developed new educational resources and training for the construction demolition industry.&lt;br /&gt;
&amp;nbsp;&lt;br /&gt;
&amp;ldquo;Demolition workers face many hazards and their lives should not be sacrificed because of deliberate neglect of demolition fundamentals,&amp;rdquo; said Assistant Secretary of Labor for Occupational Safety and Health Dr. David Michaels. &amp;ldquo;Employers must ensure that all workers involved in a demolition project are fully aware of hazards and safety precautions before work begins and as it progresses.&amp;rdquo;&lt;br /&gt;

OSHA recently launched an updated demolition website to address the hazards common in demolition operations and the safety measures that can be taken to prevent them. From 2009 to 2013, OSHA issued nearly 1,000 citations for violations of OSHA&amp;rsquo;s construction demolition standards. 			&lt;p&gt;The U.S. Department of Labor&amp;rsquo;s Occupational Safety and Health Administration has announced the launch of its annual &lt;a href=&quot;https://www.osha.gov/SLTC/heatillness/index.html&quot;&gt;Campaign to Prevent Heat Illness in Outdoor Workers&lt;/a&gt;. For the fourth consecutive year, OSHA&amp;rsquo;s campaign aims to raise awareness and educate workers and employers about the dangers of working in hot weather and provide resources and guidance to address these hazards. Workers at particular risk are those in outdoor industries, such as agriculture, construction, landscaping and transportation.&lt;br /&gt;
			&amp;nbsp;&lt;br /&gt;
			&amp;ldquo;Heat-related illnesses can be fatal, and employers are responsible for keeping workers safe,&amp;rdquo; said U.S. Secretary of Labor Thomas E. Perez. &amp;ldquo;Employers can take a few easy steps to save lives, including scheduling frequent water breaks, providing shade and allowing ample time to rest.&amp;rdquo; &amp;nbsp;&lt;br /&gt;
			&amp;nbsp;&lt;br /&gt;
			Thousands of employees become sick each year and many die from working in the heat. In 2012, there were 31 heat-related worker deaths and 4,120 heat-related worker illnesses. Labor-intensive activities in hot weather can raise body temperatures beyond the level that normally can be cooled by sweating. Heat illness initially may manifest as heat rash or heat cramps, but can quickly escalate to heat exhaustion and then heat stroke if simple preventative measures are not followed. Heat illness disproportionately affects those who have not built up a tolerance to heat (acclimatization), and it is especially dangerous for new and temporary workers.&lt;br /&gt;
			&amp;nbsp;&lt;br /&gt;
			&amp;ldquo;Acclimatization is a physical change that the body undergoes to build tolerance to heat, and it is a critical part of preventing heat illnesses and fatalities,&amp;rdquo; said Dr. David Michaels, assistant secretary of labor for occupational safety and health. &amp;ldquo;Over the past three years, lack of acclimatization was the cause in 74 percent of heat-related citations issued. Employers have a responsibility to provide workplaces that are safe from recognized hazards, including outdoor heat.&amp;rdquo;&lt;br /&gt;
			&amp;nbsp;&lt;br /&gt;
			Last year, OSHA issued 11 heat-related citations. In some of these cases, the employer and staffing agency were cited because they involved temporary workers. &amp;nbsp;&lt;br /&gt;
			&amp;nbsp;&lt;br /&gt;
			In preparation for the summer season, OSHA has developed heat illness educational materials in English and Spanish, as well as a curriculum to be used for workplace training, also available in both English and Spanish. Additionally, a Web page provides information and resources on heat illness &amp;ndash; including how to prevent it and what to do in case of an emergency &amp;ndash; for workers and employers. The app displays a risk level for workers based on the heat index, as well as reminders about protective measures that should be taken at that risk level. Since its 2011 launch, more than 130,000 users have downloaded the app. Available for Android-based platforms and the iPhone, the app can be downloaded in English and Spanish by visiting:&lt;br /&gt;

While on Wednesday, June 4, NASCAR race car driver Greg Biffle will be at the Daytona International Speedway in Daytona Beach, Florida, to demonstrate fall protection at the facility, which is currently under construction.
